Undeclared (“off-the-books”) employment

Working off the books takes away rights the law gives you. You can claim them.

Working off the books — without being registered — means going without pension contributions, without an obra social (union or employer health insurance fund), without workers’ compensation cover (ART) and without the protection the law gives every employee. The same happens, in part, when registration is done incorrectly: a later start date than your real one, or a lower salary than you actually receive.

The law allows you to claim proper registration of your employment and payment of any differences owed. Fear of losing your job is understandable: that is why every step is considered carefully.

Our team listens to you, reviews the evidence you have and explains your options clearly before going any further.

When can you make a claim?

  • You work or worked without being registered.
  • You were registered with a later start date than your real one.
  • Your pay slip shows a lower salary than you actually receive.
  • Part of your salary is paid “off the books.”
  • You are asked to invoice as a self-employed contractor (monotributista) even though you work as an employee.

What can you claim?

  • Proper registration of your employment.
  • Salary differences.
  • Pension contributions and your obra social (union or employer health insurance fund).
  • Any compensation and additional penalties that apply in your case.

How do I prove I worked there if I have no pay slips?

With messages, bank transfers, witnesses, photos and other items. At the consultation, we review what you have and what is worth gathering.

Can I be dismissed if I make a claim?

It is an understandable fear. That is why we look at your situation carefully and explain the risks and protections before taking any step.

Can I make a claim if I no longer work there?

Yes. In many cases the claim can be made after the employment has ended. There are time limits for claims, so it is best to seek advice soon.
